Please read these Terms of Service before using Lennox Health.
These Terms form a binding agreement between you and Sutter International Inc., doing business as Lennox Health (“Lennox,” “we,” “us,” or “our”). Additional clinical, pharmacy, payment, or program terms presented to you may also apply.
Agreement and eligibility
By accessing or using our websites, patient-facing technology, questionnaires, communications, programs, or other services that link to these Terms (collectively, the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old and legally capable of entering into a contract to use the Services. Services are offered only where legally available. Availability may depend on your location, provider licensure, clinical eligibility, pharmacy coverage, and other requirements.
If you use the Services for another person, you represent that you are legally authorized to act for that person and that you will provide these Terms and applicable notices to them.
Our platform role
Lennox operates a technology and administrative platform that helps users access information and connect with licensed healthcare professionals and other service providers. Lennox is not an emergency service. The identity of the healthcare professional or clinical entity responsible for your care will be disclosed through the applicable care process.
Healthcare professionals use their independent clinical judgment. Lennox does not direct or control their diagnosis, treatment recommendations, prescribing decisions, or other clinical decisions. A professional relationship is formed only with the healthcare professional or clinical entity that accepts responsibility for your care - not merely because you visit our website, complete a preliminary questionnaire, or request a review.
A request for a treatment or prescription does not require a provider to prescribe it. The provider may request more information, recommend an alternative, refer you to in-person care, or decide that no prescription is appropriate.
Not emergency care or general medical advice
The Services are not designed for medical emergencies or urgent conditions. If you believe you may have an emergency, call 911 or go to the nearest emergency department. Do not rely on website messages, portal messages, email, text, or voicemail for emergency help.
Public website and journal content is general education. It is not a diagnosis, a treatment plan, a substitute for advice from your own healthcare professional, or a guarantee that any treatment is safe or appropriate for you.
Call 911 or seek immediate in-person care. Lennox Health does not monitor its website or general support channels continuously.
Accounts and the information you provide
You agree to provide information that is current, complete, and accurate. This includes your identity, location at the time of care, contact details, health history, medications, allergies, and any other information reasonably requested for the Services. Incomplete or inaccurate information can make telehealth unsafe.
You are responsible for keeping account credentials confidential, restricting access to your device, and promptly telling us if you suspect unauthorized access. You may not create an account using another person’s identity or share an account in a way that could confuse whose information or care is involved.
Telehealth and prescriptions
Telehealth may use online questionnaires, secure messaging, telephone, video, electronic records, photos, or other technologies. You agree that telehealth has benefits, alternatives, and limitations, including the possibility that a provider cannot perform a complete physical examination or may need records, laboratory work, video, or an in-person visit.
Our Telehealth Consent provides additional information and is incorporated into these Terms when you use telehealth services. State-specific or provider-specific consent may also be required and will control if it gives you additional rights or protections.
A provider review does not guarantee a prescription. Prescriptions are issued only when a licensed provider determines they are medically appropriate and legally permitted. We do not guarantee any particular medication, formulation, route, dose, pharmacy, refill, treatment outcome, or period of access.
Medication and pharmacy services
If medication is prescribed, a separate pharmacy may dispense and ship it. Pharmacy services, product availability, shipping time, storage requirements, substitutions, and pharmacist counseling may be governed by additional pharmacy terms and applicable law.
Follow only the instructions from your prescribing provider and dispensing pharmacy. Review the product label and patient information when it arrives. Contact the provider or pharmacist if the package is damaged, the label appears incorrect, storage requirements may not have been maintained, or you have questions about use or side effects.
Compounded drugs are not FDA-approved. FDA does not review compounded drugs for safety, effectiveness, or quality before they are marketed. A provider should discuss the exact product, alternatives, material risks, and why a compounded option may be considered.
Fees, orders, and renewals
You agree to pay the fees shown to you before purchase or enrollment, including applicable taxes and shipping. You authorize us and our payment service providers to charge your selected payment method for amounts you approve. Clinical review fees may compensate professional time and do not guarantee treatment or a prescription.
If you enroll in a recurring program, the price, billing frequency, included services, renewal terms, cancellation method, and any minimum commitment will be presented before you agree. Unless the offer says otherwise, changes generally apply to future billing periods. You are responsible for canceling before the stated renewal deadline.
Order, cancellation, refund, and reshipment terms shown at checkout or in a program-specific disclosure are incorporated into these Terms. Refunds may be restricted after clinical services are performed, a prescription is transmitted, or a customized or prescription product is prepared, to the extent permitted by law.
Acceptable use
You may use the Services only for lawful, personal purposes. You may not:
- misrepresent your identity, age, location, health information, eligibility, or authority to act for someone else;
- seek medication for resale, diversion, misuse, or any purpose other than the prescribed use;
- interfere with security, probe for vulnerabilities, bypass access controls, introduce malicious code, scrape the Services, or use automated tools without written permission;
- harass, threaten, impersonate, or infringe the rights of another person;
- copy, reverse engineer, or commercially exploit the Services except where law expressly permits it; or
- use the Services in a way that violates law, professional instructions, or these Terms.
We may investigate suspected misuse and may preserve or disclose information when reasonably necessary to protect patients, users, providers, pharmacies, Lennox, or others, or to comply with law.
Content and intellectual property
The Services and their text, graphics, logos, photographs, videos, design, software, and other content are owned by or licensed to Lennox and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purpose.
If you send us feedback or suggestions, you authorize us to use them without restriction or compensation, but this does not transfer ownership of your personal information or medical records.
Third-party services
The Services may link to or interoperate with provider portals, pharmacies, laboratories, payment processors, shipping carriers, or other third parties. Their terms and privacy practices may apply to their services. A link or technical connection does not mean Lennox controls or guarantees the third party.
To the extent permitted by law, Lennox is not responsible for third-party services, content, availability, professional acts or omissions, or products. Nothing in these Terms limits any rights you may have directly against a healthcare professional, pharmacy, or other third party.
Electronic communications
You consent to receive agreements, notices, receipts, disclosures, and other records electronically. You may need a current email address, a supported device, internet access, and software capable of viewing web pages or PDF files. You may print or save copies for your records.
When you separately opt in, we may send service-related or promotional communications by email or text. Message and data rates may apply. You may opt out of marketing messages using the instructions in the message, but you may still receive non-marketing communications necessary to provide requested services, administer your account, or meet legal obligations.
Disclaimers and limitation of liability
To the fullest extent permitted by law, the non-clinical Services are provided “as is” and “as available.” Lennox disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or suitable for every purpose.
Health outcomes vary. Testimonials, examples, educational descriptions, and mechanism discussions are not promises of results. No website can eliminate the risks of treatment, technology failures, unauthorized access, or errors in information supplied by users or third parties.
To the fullest extent permitted by law, Lennox and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity arising from the non-clinical Services. Where liability cannot be excluded, it will be limited to the greater of the amount you paid Lennox for the affected non-clinical Service during the preceding six months or $100.
These exclusions do not apply where prohibited, including to liability that cannot legally be limited, and do not limit claims concerning professional medical services to the extent applicable law provides otherwise.
Changes, suspension, and termination
We may update the Services and these Terms. The “Last updated” date identifies the current version. If a change is material, we will provide notice as required by law. Continued use after an updated version becomes effective means you accept the updated Terms.
We may suspend or end access if we reasonably believe you have violated these Terms, created a safety or security risk, failed to pay amounts due, or used the Services unlawfully. We may also discontinue a Service. Ending access does not erase payment obligations or terms that by their nature should survive, including intellectual property, disclaimers, liability limits, and dispute provisions.
Before filing a dispute about the Services, you and Lennox agree to make a good-faith attempt to resolve it through support. Applicable law governs any unresolved dispute. Nothing in these Terms waives a non-waivable consumer right or prevents either party from seeking urgent protective relief.
